課程概述

As the only international trade organization, the World Trade Organization (WTO) bears a highly important role in the governance of the multilateral trad¬ing system. In parallel with the WTO, free trade agreements (FTAs) have been proliferating and playing an increasingly important part in the contemporary international economy. In recent years, there is a trend toward negotiating Mega FTAs, such as the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), Transatlantic Trade and Investment Partnership (TTIP), and the Regional Comprehensive Economic Partnership) (RCEP). Although Mega FTAs have their own limitations and problems as opposed to the WTO multilateral trading system, the new rules created by these instruments indeed represent a paradigm shift in international economic law rule-making. In this semester, we will center on the relationship between WTO and FTA, FTA-related disputes under WTO and new issues covered by Mega FTAs, in particular CPTPP.

Tentative topics to be discussed are as follows:

1. Introduction to WTO and its current crisis: An overview
2. The formation of FTA under GATT Article XXIV: WTO-plus and Non-plus aspects
3. FTA related issues at WTO: Cases and a possible systemic solution
4. WTO Specific Dispute discussion
5. WTO Specific Dispute discussion
6. WTO Specific Dispute discussion
7. FTA State-owned Enterprise Chapter
8. FTA Trade Remedy Chapter
9. FTA Intellectual Property Chapter
10. FTA SPS Chapter
11. FTA Environment Chapter

課程目標
It is hoped that this course will enhance students’ professional knowledge and capability in international trade law. 
課程要求
1. Class sessions will be mainly conducted by students’ presentations and class discussions.
2. Each student is required to present a chosen topic based on assigned papers (with other useful materials) and lead class discussion.
3. The Power-Point slides should be delivered to the instructor, teaching assistant and students via e-mail and ceiba three days prior to presentation.
4. Each student is required to share his/her term paper draft in class. The topic of the term paper needs to be approved in advance by the instructor.
5. A 10-page full-paper shall use blue book citation and be submitted at the end of the semester.
6. Attendance for all classes and active class participation are strongly encouraged. In no event, the participants should miss two classes without good reason.
7. The course evaluation will be based on four parts: class attendance (20%), class participation (25%), presentation (25%) and final term paper (30%).
8. All parts of the requirements shall be met by students. If one of the requirements is not met (e.g. without submitting the term paper or make paper presentation), no course grade will be given by the instructor.
